There are casting notices out there for SAG new media productions under the “SAG New Media Contract.” First, this is not the new media sideletter recently negotiated with the AMPTP (major studios) as part of the theatrical contract. Rather, it’s a new media contract (the SAG New Media Agreement) that’s been available to independent producers for a number of years—that is, producers who are not signatories to the theatrical and/or agreements.

Musicians Play a New (Media) Tune

In the “While you were out” department, the American Federation of Musicians and the studios signed a new deal. The New Media template adopted by the above the line unions and guilds and by IATSE has now been adopted by the Musicians as well. For instance, when a television show is streamed on ad-supported new media (such as the free version of Hulu), the above the line unions and guilds receive residuals but IATSE and AFM don’t.

Why the distinction between “new” media and “traditional” media is pointless, and a little dangerous.

Just as webcasters thought that they had their royalty obligations figured out, there comes news that the already complicated world of digital media royalties may well become more complicated. The withdrawal from ASCAP applies only to "New Media" licensing. These revised guidelines directly impact the established practices of broadcasters and new media companies. It is vital that media companies, in particular new media, understand the key provisions of these guidelines to make sure that they don’t become a target of any FTC enforcement action. For broadcast advertising, the new guidelines make clear that endorsers can themselves be liable for misleading statements made during a product pitch.
