Like the Demi Moore caper Flawless (which made millions on VOD), Two Lovers premiered first on HDnet Ultra VOD (on January 16) to be followed by a theatrical release (on February 13). Although Two Lovers played well at Cannes , nonetheless 2929 Entertainment was not able to land a better deal than their own Magnolia Pictures could deliver (the same thing happened with Barry Levinson's Robert DeNiro vehicle What Just Happened).

Unlikely to break out in a significant way--as IFC plans to launch the film direct-to-VOD as it debuts at the fest--is Alexander the Last, SXSW auteur Joe Swanberg's latest hand-held up-close-and-personal look at the lives of several characters. True confession: I am a SXSW newbie. While I've visited Austin, I have never attended this fest, which opens Friday with the Apatowish bromance I Love You, Man, which seems to be a perfect fit for the hip younger groove of SXSW.

More and more, movies that ordinarily would get a theatrical release are taking the direct train to VOD. Now the hurricane recovery drama (which conjures up the post-atomic classic Hiroshima Mon Amour ) will make its debut July 15 on Cable VOD via the new channel Cinetic Film Buff , followed by portals iTunes and Amazon VOD.

The distributor is chipper because his films have been doing well following a low-cost acquisition and release model combined with VOD. The trend for long-form movies continues at Cannes. IFC has started what is expected to be another Cannes buying spree after last year's marathon of ten ultimate acquisitions out of the festival. The three-part Red Riding Trilogy was being chased by several buyers including Bob Berney, but went to IFC.

Of course, they're concerned that these movies not be pirated, thus eating into both VOD and DVD sales -- perhaps even theatrical. In their petition, the studios signal that they won't offer such hi-def early-window VOD services without SOC. Today the studios don't offer pre-DVD hi-def VOD.

The studios' position in a nutshell is: Sure, as a purely technical matter, we could give everyone early-window HD VOD now. As I previously explained : Today the studios don't offer pre-DVD hi-def VOD. Thus the way to bring more choice to consumers is to allow the studios to use SOC, and experiment with the new early-window HD VOD service. Would an early, premium priced, high-def VOD window get people watching movies at home again and replace some of those DVD losses?

A few come immediately to mind: car leasing vs owning, free vs. pay TV, VOD vs. movie theaters, monthly subscriptions vs. annual fees, etc. About six years years ago, David Goldberg (then GM of Yahoo Music) made a pronouncement that a la carte downloads were dead. Yahoo Music was the purveyor of a very ambitious music subscription service that has been gone for almost 4 years.

Mike, Dade Hayes and I all covered the Monday morning IFC breakfast announcing day-and-date VOD and SXSW fest launch for five films appearing at the fest this spring. Steven Soderbergh (who's The Girlfriend Experience is a fest Sneak Peak tomorrow) also discussed IFC's innovative release of Che, which hits VOD Wednesday. There's so much going on that the Sundance Variety team splits things up.

One should also keep in mind that while home video sales have been declining VOD sales have grown. The filmmaker may only want to grant VOD rights on a non-exclusive basis. There are many formulas for home video deals, but most fall within three patterns.

Traditionally, films were first exhibited in theaters, followed months later by home video (DVD's), followed by a release to television beginning with Pay TV, VOD, and eventually free television. The Regal and AMC theater chains objected and the third largest theater chain, Cinemark, refused to book the picture at all if it was available on VOD so soon after its debut. This caused Universal to back down and cancel the VOD release.

The Supreme Court found that the film was indeed an "electioneering communication" and that VOD was likewise a public distribution of the film. The Supreme Court issued its landmark opinion in Citizens United v. FEC one year ago today.
