A “New” Entertainment Union - And a Possible Name
Second, “SAG” symbolizes the glamour of the movies; AFTRA symbolizes the technology of TV. Would you rather be 20 feet tall on a movie screen or 20 inches tall on a TV screen? If you work in tech, check out my book How to Write LOIs and Term Sheets. It’s undoubtedly an idea whose time has come.” Not necessarily.

AFTRA Board Approves Joint Bargaining With SAG
At a videoconference meeting today in New York and LA, AFTRA’s national board unanimously voted to approve joint bargaining with SAG for the Primetime Television Contract and the SAG TV/theatrical contract. That’s good news for an industry that can ill-afford another strike or year-long stalemate. earthquake last night.

TV Series Pickups Favor AFTRA 5 to 1
If you work in tech, check out my new book How to Write LOIs and Term Sheets. Several months ago, we learned that pilot season this year was 94% AFTRA (or 87% by some calculations), a complete 180 from its usual 90% SAG. Not so well, we now know—at least, not so well from a SAG perspective. 14% AFTRA and 86% SAG.

SAG Executive Director: TV/Theatrical Deal Will Pass
He added that having union contracts in place lowers transaction costs—that is, the existence of the union agreement makes it unnecessary for producers to repeatedly negotiate minimum terms with each individual actor. Circling back, I saved the toughest question for last: what if the TV/theatrical agreement fails to pass? So what next?

SAG TV/Theatrical Contract Ratified Overwhelmingly, 78%-22%
In a stunning defeat for the hardline Membership First faction, SAG's TV/theatrical contract passed overwhelmingly, by a 78%-22% margin (almost 4 to 1), those numbers according to the guild. SAG TV/Theatrical Ballots Later Than Expected; SAG Litigation Continues; and More
The ballots for SAG’s recently approved TV/theatrical contract won’t be going out until mid to late May, a source tells me, several weeks later than the early May target that the Guild stated as recently as a week or so ago. BTW, a copy of the proposed TV/theatrical agreement is available here. It’s expected to pass easily. What next?

Pilots Overwhelmingly AFTRA Again
But to see such figures two years in a row raises a fundamental question: Is SAG fading out of the TV business? It appears that TV producers are overwhelmingly choosing AFTRA — even though AFTRA wage rates (minimums) are several percent higher than SAG’s. Independent New Media Productions
So, disagreements that a performer may have with this agreement simply don’t relate to the compromises in the new TV/theatrical deal. And CPMs (advertising rates) for new media are at about $10 rather than $40-$50 (TV) or more, and with viewership on new media much less as well. Second, under sec. California ’s is higher— $8/hr.

SAG Letter re Force Majeure Claims
The term “ force majeure ,” as used in our collective bargaining agreements, refers to certain events that are considered outside the direct control of the parties, such as natural disasters and strikes. The term is also used to refer to the contract provisions that define each party’s rights and obligations if such an event occurs.

WGA Institutes Qualified Voting
Of course, a higher percentage of SAG actors would have been disqualified since more than 2/3’s of SAG members earn little or money from the TV/theatrical contracts in any given year, even when residuals are included in the calculation. ——————— Subscribe to my blog ( jhandel.com ) for more about entertainment law and digital media law.
