Silly Lawsuit Against SAG Dismissed; and More

DGA to Negotiate on SAG & AFTRA's Heels
Check out my residuals chart there too. In January, the National Board appointed Gil Cates as Negotiations Chair. The DGA contract (like those of SAG, AFTRA and the WGA) expires in mid-2011, but the DGA always negotiates early. If they don’t, the DGA will step in and do a deal first, setting a template that SAG and AFTRA may not like.

Court Upholds Copyright Royalty Board Decision on Satellite Radio Royalties, But Questions Board's Constitutionality
The US Court of Appeals for the District of Columbia Circuit today issued a decision basically upholding the royalty rates set by the Copyright Royalty Board due under Section 114 of the Copyright Act by satellite radio operators for the public performance of sound recordings.

SAG Board Approves Contract
The Screen Actors Guild national board narrowly approved a tentative new two-year feature-primetime contract with the AMPTP Sunday. The board passed the below motion shortly after 4:00 p.m. On behalf of the National Board, I thank them for their time, commitment and expertise.” They'll get the ballots in the mail in early May.

SAG Board Approves Studio Deal
Voting on party lines, a sharply divided SAG board approved the tentative deal with the studios yesterday by a vote of about 53% to 47%. On a personal note, I had a surreal experience outside yesterday’s board meeting. In other words—product placement at SAG’s own board meeting! Residuals for derivative new media programs.

SAG: What Might Happen at Next Week's Board Meeting
The SAG National Board is meeting next Monday and Tuesday, Jan. We know that, certainly from the hardline perspective, they include lack of jurisdiction over some original new media content; lack of residuals for virtually all original new media content; and lack of increases in DVD (home video) residuals. See above. Possible.

WGA Deal (Pretty Much) Closes. Now Let The Healing Begin.
The most notable deal points are the WGA’s exclusive jurisdiction over the Internet and cell phones, a residual kicker in new media reuse fees and separated rights. Everywhere you look, change is in the air. All indications point to the writers strike being called off by Monday ; certainly by sometime next week, at the latest.

Now let’s turn to another major sticking point for SAG: residuals for original made for new media productions. Under the AMPTP offer, there would be no residuals in most cases that involve such productions.

SAG: No Good Reason to Strike
12-13 SAG National Board meeting, reports the LA Times. Granting SAG leaders a strike authorization means they’ll almost certainly use it, unless the moderates on the National Board indeed try to stop them and in fact succeed in doing so. Such a threat might even succeed in increasing the DVD residual as well, which is long overdue.

SAG Executive Director: TV/Theatrical Deal Will Pass
Although White judiciously refrained from singling out any particular members or factions, the comment seemed clearly a response to Membership First hardliners, who have frequently pointed to the studios’ 25-year refusal to improve home video residuals as evidence that the new media deal will never improve. The votes are due back June 9.

SAG Strike Authorization Ballots Delayed
This development was revealed less than two hours ago in an email from SAG National Executive Director Doug Allen to all SAG members, which also stated that an in-person SAG National Board meeting is now set for January 12-13 (all day the 12 th and part of the day the 13 th ). The LA Times beat me on this one by about a half hour.

SAG Presidential Candidate: I'll Seek Strike Authorization Next Year if Elected
She denied that, but said that union members would feel the impact of new media defects in the existing contract before the negotiations next fall, and added that she thought at least 75% of the board will support a strike authorization. that the union’s board would support a strike authorization, albeit not unanimously. What a fizzle.
